National Criminal Background Check Fingerprinting
On January 10, 2013, Governor Patrick signed into law H.430, An Act Relative to Background Checks. The new law requires all public school employees in Massachusetts to submit to fingerprint-based state and national criminal background checks.
At this point, all newly hired staff members have complied with the fingerprinting law. Next, everyone hired before July 1, 2013 must submit to fingerprint-based background checks on a planned phased-in schedule which has begun.
The Massachusetts Department of Elementary and Secondary Education has
temporarily held off starting the checks for those employees hired prior to the present school year to allow the backlog at many of the enrollment centers to clear. According to DESE, the backlog is currently clear and pre-September 2013 employees will be checked according to a staggered schedule based on the first letter of the employee’s last name:
Schedule for fingerprinting employees hired prior to September 2013:
A-D Now through April 2015
E-K April 2015 through August 2015
L-P August 2015 through December 2015
Q-Z January 2016 through May 2016
All required checks for pre-September 2013 employees
must be completed no later than June 30, 2016. Fingerprints are available through MorphoTrust, the state-designated fingerprinting vendor, which continues to add locations and hours. Consult the MorphoTrust registration website for the latest information.
The Staff Advisory outlines the steps that all school employees must take, in order to comply with the new law. There are no exceptions to the national background check law.
