Policy IHBA: Students with Disabilities Eligible for Special Education Services

The Amherst, Pelham, and Amherst-Pelham Regional School District willprovide special education programs and services to every eligiblestudent with one or more disabilities who qualifies for services underthe Individuals with Disabilities Education Improvement Act (IDEA) andthe Massachusetts Special Education Laws (MGL 71B). In accordance withstate requirements, the District will provide specially designedinstruction and/or related services to all children with suchdisabilities from the ages of three (3) through twenty-one (21), meaningup until an individual’s 22nd birthday, who have not attained a highschool diploma or its equivalent.

In the event of a disagreement concerning diagnosis, individualizededucation plans (IEP), or placement, the parents/guardians will beaccorded the right of due process by the District.
